LIVERPOOL Council will consider taking legal action over the approval of a crematorium on Greendale Rd.

At Monday night’s council meeting, councillors voted to seek legal advice about overturning the recent Joint Regional Planning Panel (JRPP) decision in the Land and Environment Court.

If success is likely, they want to start legal action on behalf of Greendale Rd residents immediately.

Panel member and councillor Tony Hadchiti voted against the development application and raised concerns about the process.

“Was I happy with the process? Absolutely not,” Cr Hadchiti said.

“It was quite clear the JRPP members had made their decision before they walked into the room.”

Cr Gary Lucas said the decision should have rested with council.

“Part 3A planning laws have been thrown out and JRPP should follow suit,” he said. “It’s time councils had the power ... “

But a question mark remains over how the council can challenge the decision when it advised the panel to approve the application.

Greendale Rd resident Ron Sullivan said: “It’s a glaring example of inefficiency in council that this was allowed to get through.”

In the meantime, residents are scrambling to gather signatures for a petition which calls for the Planning Minister Brad Hazzard to overturn the decision and halt all the other applications for the street.
If 10,000 signatures are collected for the petition, the matter will be tabled in parliament, a spokesman for Premier Barry O’Farrell.

Mr Sullivan called on the Liverpool community to join the fight and sign the petition, saying: ``The fat lady has not yet sung.’‘
